Advocate Louise Hall began by explaining that implementing a DDA would be an intricate and complex legislative process. Existing Guernsey Employment Legislation covers sex discrimination, harassment, unfair dismissal, constructive dismissal, breach of contract, breach of implied trust and confidence etc. Proposed DDA legislation could mirror that in place in UK. The legislation would require employers to make reasonable adjustments to the working environment to facilitate the employment of a person with an impairment. Presently figures of unfair dismissal due to incapacity are relatively rare Aside A.R Sheering. A Reece Sheering has been involved with the European Social Fund which seeks to extend employment opportunities and develop a skilled and adaptable workforce. He has also had experience of working with Strawberry Fields which is run by disabled people with some mentoring from non-disabled advisors. Some definitions of impairment which are included in DDA are cancer, blindness, HIV, MS, however there are other underlying impairments such as mental illnesses, which impinge on performance of duties. Professionally accepted criteria from WHO requires proof of impairment in cases of learning disabilities and genetic deformity. Tribunals. An independent medical examination is required for all stress related claims, which will cost 4,000.00 to 6,000.00. Legal Aid would not ordinarily be granted for an employment tribunal, and the claimant would have to have a reasonable chance of success before choosing to proceed. In her opinion, Louise Hall stated that Legal Aid would need to go hand in glove with DDA in order for the legislation to have success. The burden of proof lies with the claimant. In Louise Halls opinion, a Guernsey DDA would need to follow UK, as there is no point in re inventing the wheel. The employers point of view should be considered re cost implications of adjustments to the working environment. In Advocate Halls opinion from a legal perspective, it will be a battle to persuade a society such as Guernsey, that has little employment discrimination, that a DDA is a necessary piece of legislation. Human rights legislation covers some of the implications ART 3and refers to degrading and discriminating treatment. Louise Hall left the meeting after being thanked by R.Platts. Chairmans report A brief resume was given for the benefit of those present who had not attended previous meetings. The group is now registered as a Guernsey Charity and is tax exempt. R. Platts and S. Green have approached Lloyds TSB for funding. The application form must be completed by the autumn. Membership of the sub groups is at present duplicated, and more volunteers to man these groups are required. Until and unless more volunteers come forward, it was agreed that the sub groups would decide on priorities and concentrate on one task at a time. Anyone Interested in joining a group will be welcome. It has been suggested that meetings end at 9pm, and reports are kept short. From the floor, N Humphries urged that in the light of past experience HSSD need to be reminded of the commitment to progressing the Forum. Reports from Sub Groups Access J.Tebbutt. The group has defined its remit, prioritised its projects and allocated responsibilities. Education Environment, Employment and Goods and Services were under discussion and after consideration Environment was prioritised. A R Sheerin has invited Andy Mauger to attend a future meeting and this invitation has been extended to building control. B.Vaudin suggested IDC attendance at meetings would be of benefit. She had spoken to Deputy Hunter Adam and Chief Minister Lyndon Trott, who seemed sympathetic to the needs of people with disabilities. Law R.Platts. Rob Platts and Shelaine Green were working on this. J.Gollop commented that legislation would require 1. Local Legislation, 2. Education or 3. Imposed legislature from Whitehall. RP is hoping to meet Deputy Hunter Adam in July. TSB has suggested that a legally trained Non Exec chairman of high repute would be advantageous in the process of presenting the proposed report on Disability in Guernsey to States members and law officers. The group would then need a Chief Executive Officer to take on the role that Rob Platts is currently undertaking. RP, SG, ARSheerin and WB to consider. Suggestions to be brought to a future meeting. Support W.Beaven. The first meeting was jointly held with the Access group. W.Beaven felt that there were two distinct objects of the VOG. Long and short term goals. Firstly, the legal process of implementing a DDA, which could take years, and secondly the needs of people at this moment in time. The support sub committee should be dealing with the latter. Consequently the issues surrounding carers, wheelchairs, rehab, access guides respite, befriending and day care could all be classed as Access but prioritised in a different way. Housing and accommodation requirements need also to be included.This would focus the work in hand, as the activities of daily living which all require support. WB also proposed to form a sub group of people with impairments as at this juncture the people who are living with a disability are not fully represented. It is they as the user group who need to lead the discussions. WB urged members to think of disabilities other than those using wheelchairs. Cancer, pulmonary conditions and mental health issues all need to be addressed. WB urged all charities that had received copies of Alice Flowers report to respond to David Hughes. WB to check with Alice Flower if the report is now in the public domain. Publicity On behalf of S Green, AR Sheerin explained that the group had held a brainstorming session to identify the key audiences for VOGs message and PR ideas to reach each audience. The Group then prioritised the different ideas. The Group decided that the most important audience at this stage was States Deputies. A letter introducing the VOG, plus a factsheet briefly explaining disability issues in Guernsey will be developed. . All publicity must go through either the chair or S.Green.
